In the ground-breaking 2018 judgment of Navtej Singh Johar v. Union of India, the Hon'ble Supreme Court of India ushered in a new era by decriminalizing homosexuality, marking a pivotal moment in the country's legal history. However, this progressive stride was accompanied by persistent questions concerning homosexual rights that remained unexplored within both cultural and legal frameworks. Despite the legal acknowledgment, members of the homosexual community are often professed merely as 'individuals' and not fully integrated into mainstream society. This perception (...) is aggravated by the absence of a societal 'stamp of marriage,' reinforcing their marginalization. In the realm of Hindu law, the sanctity of marriage is deeply rooted in the scriptures, which explicitly define it as the union of 'two souls.' Remarkably, these very scriptures also assert that a soul is inherently without gender, elucidating that gender is a characteristic exclusive to the human body. It is crucial to recognize that Hindu law, including the relevant Acts, draws extensively from these scriptures, making them a fundamental source of legal principles. The legislation, such as the Hindu Marriage Act, essentially serves to codify and organize the pre-existing Hindu law without seeking to undermine the intrinsic values enshrined within the Holy Scriptures. This article aims to delve into the unaddressed aspects of homosexual rights within the contemporary legal framework, shedding light on the denied rights that persist. While global attitudes are progressing towards recognizing and safeguarding homosexual rights, the Indian government and cultural factors appear hesitant to renounce orthodox and conservative stances. This article seeks to analyse and critique these aspects, exploring the challenges hindering the full acceptance and integration of homosexual individuals into the broader societal fabric despite the transformative legal landscape initiated by the Navtej Singh Johar case. By its nature, comparative education values diversity. Respectfully studying how different groups pursue education provides opportunities to learn about the variety of human experience, expand the boundaries of the field, and ultimately re-understand ourselves. At its core, the field leverages the dynamic space between life as culturally located and being human. This chapter contributes value to comparative education from an Oceanic viewpoint. Oceania is the world region with more water and languages than any other. Because of its diversity and colonial (...) histories, Oceania is a site of creative tension between regionalism and self-determination. Unsurprisingly, conflict exists in the region. However, a key need in our ‘sea of islands’ for sustainability is to live well together. Faced with the uncertainties of the future such as climate change, mutual understanding and support is at a premium. The collaboration of writers; Solomon Islander, Tongan, and Anglo-Welsh, embodies this, as does the chapter’s woven mat-based structure. The thrust of this chapter is that through walking backwards into the future and embracing solidarity through diversity, we can promote a sustainable educational journey that offers the hope of continuity in the face of the challenges ahead. For human interaction, it is important to understand what emotional state others are in. Especially the observation of faces aids us in putting behaviours into context and gives insight into emotions and mental states of others. Detecting whether someone is nervous, a form of state anxiety, is such an example as it reveals a person’s familiarity and contentment with the circumstances. With recent developments in computer vision we developed behavioural nervousness models to show which time-varying facial cues reveal whether someone (...) is nervous in an interview setting. The facial changes, reflecting a state of anxiety, led to more visual exposure and less chemosensory (taste and olfaction) exposure. However, experienced observers had difficulty picking up these changes and failed to detect nervousness levels accurately therewith. This study highlights humans’ limited capacity in determining complex emotional states but at the same time provides an automated model that can assist us in achieving fair assessments of so far unexplored emotional states. BackgroundCarefully planned research is critical to developing policies and interventions that counter physical, psychological and social challenges faced by young people living with HIV/aids, without increasing burdens. Such studies, however, must navigate a ‘vulnerability paradox’, since including potentially vulnerable groups also risks unintentionally worsening their situation. Through embedded social science research, linked to a cohort study involving Adolescents Living with HIV/aids (ALH) in Kenya, we develop an account of researchers’ responsibilities towards young people, incorporating concepts of vulnerability, resilience, and agency (...) as ‘interacting layers’.MethodsUsing a qualitative, iterative approach across three linked data collection phases including interviews, group discussions, observations and a participatory workshop, we explored stakeholders’ perspectives on vulnerability and resilience of young people living with HIV/aids, in relation to home and community, school, health care and health research participation. A total of 62 policy, provider, research, and community-based stakeholders were involved, including 27 ALH participating in a longitudinal cohort study. Data analysis drew on a Framework Analysis approach; ethical analysis adapts Luna’s layered account of vulnerability.ResultsALH experienced forms of vulnerability and resilience in their daily lives in which socioeconomic context, institutional policies, organisational systems and interpersonal relations were key, interrelated influences. Anticipated and experienced forms of stigma and discrimination in schools, health clinics and communities were linked to actions undermining ART adherence, worsening physical and mental health, and poor educational outcomes, indicating cascading forms of vulnerability, resulting in worsened vulnerabilities. Positive inputs within and across sectors could build resilience, improve outcomes, and support positive research experiences.ConclusionsThe most serious forms of vulnerability faced by ALH in the cohort study were related to structural, inter-sectoral influences, unrelated to study participation and underscored by constraints to their agency. Vulnerabilities, including cascading forms, were potentially responsive to policy-based and interpersonal actions. Stakeholder engagement supported cohort design and implementation, building privacy, stakeholder understanding, interpersonal relations and ancillary care policies. Structural forms of vulnerability underscore researchers’ responsibilities to work within multi-sectoral partnerships to plan and implement studies involving ALH, share findings in a timely way and contribute to policies addressing known causes of vulnerabilities. A child’s death is a profound loss for mothers and affects hundreds of thousands of women. Mothers report inconsolable and progressive grief that is distinct from depression and impacts daily emotions and functions. The brain mechanisms responsible for this relatively common and profound mental health problem are unclear, hampering its clinical recognition and care. In an initial exploration of this condition, we used resting state functional MRI (fMRI) scans to examine functional connectivity in key circuits, and task-based fMRI to examine (...) brain network activity in grieving mothers in response to pictures of their deceased child and as well as recognizable deceased celebrities and unfamiliar individuals. We compared nine mothers who had lost an adult child and aged-matched control mothers with a living child of a similar age. Additionally, we collected diffusion imaging scans to probe structural connectivity and complemented the imaging studies with neuropsychological assessments. Increased functional activation in Ventral Attention/Salience Networks accompanied by a reduced activation in the medial prefrontal cortex in response to the deceased child’s picture robustly distinguished the grieving mothers from controls. Heightened resting-state functional connectivity between the paraventricular thalamic nucleus (PVT) and the amygdala distinguished the grieving mothers from the controls and correlated with subjective grief severity. Structurally, maternal grief and its severity were associated with alterations in corticolimbic white matter tracts. Finally, grieving mothers performed worse than controls on neuropsychological tests of learning, memory, and executive function, linked with grief severity. Reduced activation in cortical regions inhibiting emotions and changes in the PVT circuitry—a region involved in long-term emotional memories and decision making under conflict—distinguish grieving mothers from controls. Notably, the magnitude of neurobiological changes correlates with the subjective severity of grief. Together, these new discoveries delineate a prevalent and under-recognized mental health syndrome and chart a path for its appreciation and care. (shrink)

This study aimed to explore the enabling context of the HIV care continuum as perceived by people living with HIV and healthcare professionals. This qualitative study involved in‐depth individual interviews with eight people living with HIV and group interviews with seven nurses and physicians. These interviews took place between March 5, 2021, and July 13, 2022. Thematic analysis was conducted. The main themes that emerged included “network of support and systems,” “personal gains from the care continuum,” “continuity and practicality of (...) healthcare services,” “presence of significant other(s),” and “social belonging.” These themes were structured within the five levels of the socio‐ecological model (system, individual, organizational, interpersonal, and community levels), and 10 subthemes were identified. With the integration of themes, the enabling context was compared to a “care orbit,” indicating that people diagnosed with HIV start treatment at the system level and continue HIV care at other levels. In addition to primary support at the system level, the enabling context also includes individual commitment to care and regular health habits, hospital services, support from significant others, and community culture. Together, the context helps guide people living with HIV into the “orbit” of the care system. (shrink)

Respecting patients’ rights is a fundamental aspect of providing quality healthcare. The present investigation attempts to explore the awareness among patients about their rights in a coastal township in India. A questionnaire-based cross-sectional study was carried out among 215 patients admitted to the wards of a tertiary care teaching hospital in Mangalore. Awareness among patients regarding their rights varied for various issues and ranged between 48.4 and 87.4 %. Awareness about patients’ rights was independent of gender, socio-economic and educational status. (...) Doctors were found to be the most common source of information for patient’s about their rights in the study. Doctors must conform to the relevant legislations and involve patients in all aspects of healthcare. This paper examines several passages in which Nietzsche considers burgeoning Christianity’s relationship to the secretive “mystery cults” that flourished alongside the official state religions of ancient Rome. The purpose of this paper is four-fold. i) To shed light on an unexplored aspect of Nietzsche’s philosophy. ii) To explore the intellectual reality behind some of his specific charges concerning Pauline Christianity’s indebtedness to the ancient Mithras cult. iii) To assess the validity of several of Nietzsche’s accusations in this area in light (...) of more recent scholarship. iv) To contrast the middle-period Nietzsche’s treatment of this theme with several of his end-of-career ruminations. I make the case that while some of his later claims concerning this topic are indeed exaggerated, they nonetheless reveal remarkable insight into a fascinating aspect of late antiquity. (shrink)

Nāgārjuna’s “middle path” charts a course between two extremes: Nihilism, and Absolutism, not unlike earlier Buddhism. However, as early Buddhists countinanced constituents of reality as characterizable by essences while macroscopic objects lack such essences, Nāgārjuna argues that all things lack what he calls svabhāva – “own being” – the Sanskrit term for essence. Since everything lacks an essence, it is Empty (śūnya). To lack an essence is to lack autonomy. The corollary of this is that all things are interrelated. The (...) Mahāyāna (Great Vehicle) school of Buddhist thought draws heavily on this insight: if all things are related, individualism has to give way to inclusivity. According to Nāgārjuna, the key to understanding his Middle path philosophy is dharma: ethics. It is only by a prior commitment to ethics that we can properly understand the Buddha's philosophy as teaching no doctrine of reality, for it is not a teaching of metaphysics, but of ethics, which is to say, Dharma. At the center of Dharma is a kind of Contractualism of the Buddhist community (saṅga). A failure to approach emptiness via ethics is like trying to hold a snake dangerously. However, approaching the emptiness of reality via ethics is grounds for optimism: nothing is stuck by essence, and we have reason to believe in positive change made possible by prudent ethical choice. In this module I consider some objections to Nāgārjuna's position from Vedic positions, and Yoga, and identify responses available to Nāgārjuna. (shrink)

Research indicates that consumers are particularly concerned about the safety of meat. More highly processed meat is perceived as more unsafe than fresh or natural meats, i.e., consumers trust processed meat less. This paper studies the relationship between perceived trust and day-to-day purchase behavior for meat, giving special attention to the degree of meat processing. Controlling for trust in food chain actors and demographic and socio-economic variables, actual meat purchases of Canadian households are linked to answers from a commissioned food (...) attitudes survey completed by the same households. Expenditures for processed and total meat (but not for fresh meat) are significantly different by three levels of trust in the food industry. Consumer with the lowest trust levels consume less (especially of processed meat) compared to those with higher trust levels. However, in a multivariate setting, trust shows no effect on fresh or processed meat purchases with or without demographic and socio-economic control variables, suggesting that the impact of trust on meat purchases is only small. However, the low trusting consumer segment could potentially be a target for marketing strategies focused on reputation and quality to increase sales in this particular group. (shrink)

Questions of patient autonomy have formed an important part of ethical debate in medicine from at least the post-war period onwards. Although initially important as a counterweight to widespread medical paternalism, recent years have seen a reaction against a widely perceived ‘triumph of autonomy’. In particular, competent patients' refusal of life-saving or clearly beneficial treatment presents complex dilemmas for both healthcare professionals and ethicists. Discussion of the mechanism provided by the Israel Patient's Rights Act of 1996 for ethics committees to (...) override refusal of treatment by such patients has provided several examples in which it seems an obligation to benefit the patient can outweigh concerns regarding respect for their autonomy. However, such analyses as have been undertaken so far may be seen to omit important elements of the moral decision-making process that takes place even when the latter appears to ‘win out’. In addition to helping better prepare clinicians to meet such challenges in the future, a fuller appreciation of those elements that are present in justified cases of coercive treatment may enable them to arrive at a better understanding of what autonomy itself can mean in a medical context. BACKGROUND: Hallucinations and delusions that complicate Parkinson’s disease could lead to nursing home placement and are linked to increased mortality. Cognitive impairments are typically associated with the presence of hallucinations but there are no data regarding whether such a relationship exists with delusions. OBJECTIVE: We hypothesized that hallucinations would be associated with executive and visuospatial disturbance. An exploratory examination of cognitive correlates of delusions was also completed to address the question of whether they differ from hallucinations. METHODS: 144 PD subjects (...) completed a neuropsychological battery to assess cognition and the SAPS to examine psychosis. Correlational analyses assessed associations between hallucinations and delusions with cognitive domains. RESULTS: 48 subjects reported psychotic symptoms: 25 experienced hallucinations without delusions, 23 had symptoms dominated by delusions. Severity and/or number of hallucination subtypes were significantly correlated with lower scores in language, memory, attention, executive functioning, and visuospatial ability. Correlations with delusions were non-significant. Tests of differences in the size of the correlations between groups revealed a significant relationship between language and visuospatial performance with hallucinations. CONCLUSIONS: Cognitive correlates of hallucinations and delusions appear to be different in PD, suggesting distinct pathogenic mechanisms and possibly anatomical substrates. Hence, delusions may not share the same associations with dementia as hallucinations. Since this is a new finding, further studies will be needed to confirm our results. (shrink)

In the 1950s, E.T. Gendlin developed a philosophical system, published as Experiencing and the Creation of Meaning, to explain the role of bodily feelings in cognition, and he then evolved a psychotherapy known as Focusing, based on this system. Focusing works primarily with bodily feelings and how they relate to the thinking processes. Gendlin’s work has had an important impact on the field of Psychology. An aspect of the historicity of E.T. Gendlin’s work is that it has intriguing similarities with (...) how the Vipassana meditation teacher S.N. Goenka, teaches, in line with the Pali Nikayas, that a correct understanding of affective bodily feelings can lead to the dissolution of destructive emotional tendencies. This article uses these similarities to begin a process, from a Western academic perspective, of conceptualizing the efficacy of Vipassana meditation, as taught by S.N. Goenka, in dissolving harmful emotional habits. This will be done by comparing how S.N. Goenka and E.T. Gendlin understand the operative factors in personality change. (shrink)

Scholarship on the Euthydemus has largely focused on the protreptic character of the Euthydemus—that is, the manner by which Socrates attempts to turn the young Cleinias toward philosophy. By focusing on the dramatic structure of the text, and above all its comic tenor, this article argues that it is Crito—he to whom Socrates tells his hilarious story of his encounter with the two sophist-brothers—who is the real object of Socrates’s protreptic speech.

Problem: Mitterer's critique of the central argumentations of radical constructivists has been mostly neglected until today. The paper presents and evaluates his criticism and, in the second part, outlines a format of constructivism that tries to draw appropriate consequences. Solution: In his critique Mitterer explains why the radical constructivism represented above all by Maturana, Varela, von Glasersfeld or Roth still remains in a dualistic format. In his view Neurobiology is used in their writings as the indisputable basis for deriving far-reaching (...) epistemological consequences. Therefore constructivism evades self-application. To overcome this serious critique a different approach to constructivist thinking is sketched that operates without using any biological or psychological theories, tries to avoid dualism, and elaborates Mitterer's basic argument that the description of an object and the object under description are the same. Benefits: The paper shows what constructivism can learn from a serious critique and how it can be rewritten in a non-dualistic way. (shrink)
